Charter Terms & Conditions
Title tag: Charter Terms & Conditions · Croatian Law · Marina Frapa In force: 1 January 2025 · Reviewed: 6 May 2026
These conditions apply to every Boat Charter Dubrovnik booking — self-drive, skippered, sunset, full-day or multi-day. Reading them is part of accepting them. If something here clashes with what we said by email or WhatsApp, the email / WhatsApp message wins for that specific booking; otherwise, this page rules.
Questions before you book? info@boatcharterdubrovnik.com or WhatsApp +385 99 380 4156.
Rule 1 · A booking only counts when we confirm it in writing
Submitting the booking form, sending an email, or messaging us on WhatsApp starts a booking — it does not finalise one. The Boat Charter Dubrovnik is contractually live only after:
- Marin sends you a written confirmation (email or WhatsApp), and
- The 25% deposit clears through Stripe or PayPal.
Until both happen, no charter is reserved against the date you asked for. If the boat goes to another guest in the meantime, that’s the consequence of an unfunded booking — no claim arises.
Rule 2 · The lead booker is responsible for the whole party
When you book on behalf of friends, family or colleagues, you are warranting that:
- you have authority to bind them to these conditions;
- they will read the safety briefing and follow it;
- you will pass on any operational message we send (weather call, dock change, departure-time shift).
If a member of your party arrives drunk, refuses a life jacket, or behaves dangerously, the skipper can refuse them boarding without refund — and we’ll address it through you, not them.
Rule 3 · Information given at booking has to be accurate
Number of guests (adults / children / infants), special requirements, mobility constraints and contact details all need to be correct at booking. Misrepresenting party size to fit a smaller boat, hiding a medical condition that affects the safety brief, or giving a phone number we can’t reach voids the cancellation protections in Rule 8.
Rule 4 · What you’re chartering
Boat Charter Dubrovnik runs nine vessels from Marina Frapa, Gruž — three self-drive (no licence required), six skippered. Pricing, capacity and inclusions are listed on the charter pages. Wherever a boat is listed at “from €X”, that figure is the lowest available block (typically a half-day weekday slot in shoulder season); peak-season weekends and longer blocks are priced higher and quoted at booking.
We retain the right to substitute one boat for an equivalent one in our fleet (same or higher capacity, same or higher class) where mechanical or scheduling reasons require it. The booking value does not change in either direction.
Rule 5 · Pricing and how to pay
- All prices are in euro (EUR), VAT included where applicable
- A 25% deposit confirms a Boat Charter Dubrovnik; the balance is paid on the dock in cash (EUR) or by card
- For full-day skippered charters, multi-day yacht charters and group bookings, full pre-payment by SEPA bank transfer is also accepted
- Self-drive Boat Charter Dubrovnik bookings carry an additional €500 refundable damage deposit taken on the day at the marina (waiver available at €25/day)
- Prices that change after you’ve been confirmed do not affect your booking — the figure on your confirmation is the figure you owe
Third-party platform bookings (Viator, GetYourGuide, TripAdvisor) follow the platform’s payment terms; once we receive the booking, our terms apply to the on-water service.
Rule 6 · The skipper has the final word on the water
On every skippered Boat Charter Dubrovnik, the captain holds Croatian Maritime Authority Cat. C licence and final operational authority. The captain may:
- decline to depart if conditions are unsafe
- divert the route mid-charter for weather, traffic or mechanical reasons
- cut a charter short for medical or safety reasons
- refuse boarding to anyone who, in their professional view, can’t safely be on the water
These calls are not negotiable on the dock or at sea. They are reviewable after the fact through Marin on email — but only after the charter is over.
Rule 7 · Weather and routing
The Adriatic does what it does. Three scenarios:
The skipper cancels the entire charter because of bura, jugo, fog or sea state. You receive 100% refund or free reschedule, your call.
The route is modified — we still sail, but we redirect from the open Adriatic to sheltered waters (Lokrum, Šipan lee, Lopud bay, the Cavtat coast) because the planned destination isn’t safe that day. The Boat Charter Dubrovnik delivers a comparable experience and the booking is not refundable on routing grounds alone.
You cancel because of weather you don’t like but the captain has cleared the day as safe (light rain, overcast skies, a light mistral). The standard cancellation tiers in Rule 8 apply — the weather refund does not.
The captain’s safety call is not an opinion; it’s the legal call of a Cat. C-licensed master mariner.
Rule 8 · Cancellation, in summary
Detailed tiers, processing times and FAQ are on the Cancellation page. The headline is:
- More than 24 hours before departure — 100% refund
- Between 12 and 24 hours — 50% refund
- Less than 12 hours, or no-show — no refund
- Skipper-cancelled for weather — 100% refund or free reschedule, always
Refunds return to the original payment route and arrive in 3–10 working days depending on processor.
Rule 9 · What you sign up to as a guest on the boat
By boarding any Boat Charter Dubrovnik vessel, you accept that:
- Skipper and crew instructions are followed at all times
- Life jackets are worn whenever the captain says so (and at all times for under-12s)
- Boarding under heavy intoxication is grounds for refusal without refund
- Any pre-existing medical condition relevant to safety (cardiac, neurological, mobility, pregnancy, severe motion sensitivity) was disclosed at booking
- Personal belongings are your responsibility — phones, cameras and passports are at your risk on the deck
If we have to remove someone mid-charter for safety, the charter ends there. We will not refund the unused portion in that case.
Rule 10 · Children, mobility and accessibility
- Under-18s travel with a parent or guardian; we don’t take unaccompanied minors
- Under-12s wear a child-size life jacket continuously
- Mobility constraints are workable on most charters — tell Marin at booking and we’ll have step-free boarding pre-staged and a crew member ready
- Some routes (Mljet’s narrow harbours, Pakleni’s anchorage swims) involve agility that we can’t bypass — we’ll flag that at booking before you commit
Rule 11 · What we are not responsible for
Within the maximum allowed under Croatian law:
- Indirect, consequential or incidental losses — including missed onward flights, hotel rebookings, holiday-of-a-lifetime claims
- Force majeure — natural disaster, government order, port closure, strike, pandemic, civil unrest
- Acts and omissions of third parties — taxis we book on your behalf, restaurants we reserve, photographers contracted as add-ons
- Lost, stolen or damaged personal property while on the charter
Our maximum liability in any claim arising from a Boat Charter Dubrovnik booking is capped at the total amount paid for that specific charter. €1,000,000 per-incident passenger liability insurance with Croatia osiguranje sits above and beyond that cap for personal injury.
Rule 12 · Self-drive — additional terms
If you book a self-drive Boat Charter Dubrovnik (Pasara 5 HP, Barracuda 530, Fisher 20):
- The named operator must be 18+ and present photo ID at the marina
- Operating BAC limit is 0.05% (Croatian limit) — passengers may drink, the helmsman may not
- The €500 damage deposit is held against the boat and refunded in full on return absent damage
- Operation is daytime only; the boat must be docked at Marina Frapa by the agreed return time
- A 20-minute pre-departure briefing is mandatory and recorded as accepted on the rental sheet
- Damage from grossly negligent operation is not covered by the standard waiver
Rule 13 · Photography and image use
The crew or a contracted photographer may take stills and short video on a Boat Charter Dubrovnik. By boarding you consent to non-commercial use of those images on our website and social channels. Tell the skipper at boarding if you’d rather not appear, and we’ll keep you out of frame.
You retain full rights to the images you take yourself — with one ask: tag us if you post.
Rule 14 · Reviews
Honest reviews — five-star, three-star, one-star — are welcome on Google, TripAdvisor, Trustpilot, Viator or GetYourGuide. By writing one you grant us a non-exclusive, non-transferable licence to repeat or excerpt it on our site or printed material. Defamatory, fabricated or off-topic reviews are flagged with the platform.
Rule 15 · Intellectual property
The text, photography, route maps, schema markup and brand identity on this site belong to Boat Charter Dubrovnik. You may quote up to two paragraphs with a link back; full-page reproduction without written permission is not allowed.
Rule 16 · Governing law and disputes
These conditions are read under Croatian law. Any dispute we cannot settle by good-faith negotiation goes to the competent courts in Dubrovnik, Croatia. EU consumers retain their statutory right to sue at home where local law allows it. The European Online Dispute Resolution platform sits at ec.europa.eu/consumers/odr for cross-border claims.
Rule 17 · If part of these conditions is invalid
The rest still applies. A court striking out one rule under Croatian law does not collapse the others.
Rule 18 · Changes
Material changes to these conditions appear at the top of this page with a new “Reviewed” date. Bookings made before the change are governed by the version in force at the time of booking; ongoing bookings are not retro-amended.
